If good Ole’ “Doc” Comfort hasn't clearly stated this, hand it back to him and tell him he must. You have every right to insist that he does. You're paying his bills, it's your report, your insurance claim, and your big bucks he's not being serious about!

As long as you continue to have physical problems you should keep going back to see your doctor, again and again, and again ! Other than the obvious "Pain and Suffering" it will help to convince Rock Solid Insurance you’ve endured, there are two other very good reasons for doing this. They are as follows:

(1) The fact that your records show visit’s to your doctor, four, six, eight (or even more) weeks after the accident, will convince Adjuster Strong and Rock Solid that your injury took a long time to deal and required continual attention. (Plus it clearly indicates each and every day you were unable to work and therefore it proves, beyond the shadow of any doubt, the income you lost). Never forget: Your attending physician’s Medical Report is the only way you can prove you were unable to work and in any court of law that will justify your claim for lost wages.

(2) When you visit “Doc” Comfort be sure to tell him there's been little (if any!) decrease of your pain, discomfort, stiffness or immobility. Make sure, when he does execute that Final Medical Report, this is clearly stated in his written remarks. If it isn't you have every right to go back, hand it to him and insist that it is.

SCARS: In many instances large and obvious scaring increase's the value of your claim (big time!) - - especially if the scarred portion of your body is visible. If you've been sitting at a desk for 25 years, your chin is double, your hair is gone, and you own a bulging stomach, and that’s where the scar is, it’s not going to be worth much. But, if you're a tall, dark and handsome, twenty year old and the scar is on your face, than it's worth a ton. Take colored photographs of every scar and every scrape that causes swelling and/or discoloration to your skin plus every mark on your body! After you’ve handed a copy of those photographs to Adjuster I M. Strong he’ll be sending them to his boss in the Home Office. I’ve been in that seat so I can flat out guarantee you his immediate superior in the home office will stare at those photo’s and gulp. He’ll blanch, take a deep breath and send Strong a one liner that reads something like: “Do whatever it takes to get rid of this one. Se!

ttle it and let‘s move on.”

If the scar is bad enough insist that Dr. Comfort refer you to a Plastic Surgeon for an opinion as to whether your scar can be repaired and/or removed. Once you've been examined ask that Specialist to detail in writing (and insist that he send his report to you) how much it will cost to make it look right again. You may never get it repaired, and/or removed, but include that Plastic Surgeon's report, plus copies of the bills you’ve accumulated because of your visits to him, and hand them to Adjuster Strong. This will absolutely, positively give your claim more value !

QUESTIONS & ANSWERS REGARDING OBTAINING THE SERVICES OF A LAWYER:

QUESTION: “Is it necessary to obtain the services of an attorney who will take a cut of 33 1/3% of the settlement (in some states up to 50%) he recovers from the insurance company of the individual who struck you“? ANSWER: “Yes, there are some situations where it makes sense to do so“. QUESTION: “Should that lawyer take 33/13% ($1,333.33) of that $4,000“? ANSWER: “No“! QUESTION: “Why not“? ANSWER: “Because you were going to get that $4,000 weather there was an attorney representing you or not“! To be fair he should not take 1/3 of $8,800 ($2,933.33 - - thus leaving you with $5,866.66) but 1/3 of the $4,800 ($1,600 - - thus leaving you with $7,200). QUESTION: “What has he done to earn that additional $1,333.34“? ANSWER: “Absolutely nothing”!

I Had a Car Accident - Do I Need an Attorney?

Every day in California, with its network of Freeways and traffic congestion, there are thousands of car accidents ranging from minor fender benders to catastrophic life altering experiences and/or death. If you are one of the unfortunate people who are in this group you undoubtedly have asked yourself the question "Do I need an Attorney?"

In cases where the injuries are substantial there is no question that a qualified and experienced personal injury litigator should be retained as quickly as possible. It is the usual pattern that a person is first diagnosed with "soft tissue injuries" if x-rays do not reveal any broken bones. Tunnel of Death (Lefortovo Tunnel, Russia)

The 3150 m long Lefortovo Tunnel in Russia is the longest 'in-city' tunnel in all of Europe. There is a river running over it and water leaks at some points. When the temperature reaches minus 38 degrees like it did last winter, the road freezes and the result is the attached video taken during a single day with the tunnel camera. Helmut Newton, born Helmut Neustädter (31 October 1920, Berlin, Germany 23 January 2004, West Hollywood, California, USA) was a German-Australian fashion photographer noted for his nude studies of women. Born Schoneberg, Berlin, to a German-Jewish button-factory owner and an American mother, Newton attended the Heinrich-von-Treitschke-Realgymnasium and the American School in Berlin. After arriving in Singapore he decided to remain as a reporter for the Straits Times and worked as a portrait photographer. Recently, I represented a man who was biking home from work at his job at a computer company. He was travelling on a busy roadway at rush hour, using the "bicycle lane" on the shoulder of the roadway. It was about 5:30 p.m. He was wearing a helmet, reflective bike shoes, and a highly visible biking jersey. The traffic going in his direction was in stop & go traffic, but on the shoulder lane he had clear sailing.

He was biking on a slight uphill doing about 10 miles per hour. A car travelling in the opposite direction decided it need to turn into a strip mall just about where my client was riding. Unfortunately for my client, the car made a very swift left turn, and because of the stopped car traffic adjacent to my client, never saw him as he accelerated toward the driveway to the strip mall. Who won? The car- as always.

Who lost? My client. His fancy road bike, the least of his problems, was totally destroyed. He suffered fractures, bruises, cuts and lacerations. An ambulance deposited him to the closest emergency room, where he underwent a battery of tests, including x-rays, CT scans, blood tests and an overnight stay at the hospital. The impact put him out of work for over a month, and he needed repeat visits to the orthopedist to follow his fractures and make sure they were healing properly. After the orthopedist gave the ok, he was told to start physical therapy to begin to use his arm and leg properly again.

My client lost his dignity that day. He lost the ability to continue his bike-ride home without interference from a car. His family was thrown into turmoil, rallying around dad in the emergency room. He had to explain to his boss why he couldn't return to work for weeks. He had to explain to his friends why he couldn't join them in their activities. He sat at home, useless to his wife, on the couch watching mindless television.

On the day I met my client for the first time, he had returned to work in a limited capacity, and at reduced hours. The most important thing he wanted to show me was not his scars and his cast. Rather, he wanted to show me his broken and destroyed bicycle that sat in a crumpled heap inside his car. As any bicyclist knows, a good bike is a trustworthy friend that gets you from point A to point B effortlessly. When that has been destroyed, it is devastating. However, as all things material, it can and will eventually be replaced. My client's life was miraculously spared that day, and he will learn once again to walk, to run, to write, and yes, to bike.

The driver of the car, unfortunately, had a limited insurance policy, which nevertheless was quickly offered to settle the case.

Remember to always wear your helmet when you ride, and make yourself as visible as possible to the motorists around you. Never wear earphones to listen to your Ipod or MP3 player, as you will not be able to hear the traffic around you. Be smart, and enjoy your bike ride.

Usually, the way it is reported on your credit record involves the words "Settled" or "Settled as Agreed" or "Paid as Agreed". However, all the late payments may remain on your credit report until the statute of limitations runs out.
